Correct. Unless he destroys the tester or makes it unusable it's not a kos. Also what mods said he couldn't?

he was making it unusable by running around with it and later destroying it by using up all 3 test.

By making it unusable i mean throwing it over the side of a map. using all 3 tests and running around with it, again, isn't kosable.
